These Terms of Service ("Terms") govern access to and use of mapzl.com (the "Platform").

The Platform enables users to create, sell, and purchase digital travel guides. By using the Platform, you agree to these Terms.


1. Eligibility

You must be at least 18 years old or the legal age of majority in your country of residence to use the Platform.

2. Marketplace Role

The Platform operates as an online marketplace connecting independent travel guide creators ("Creators") with customers ("Consumers").

The Company acts as an intermediary between Consumers and Creators. Its responsibilities under these Terms are limited to making the Platform available and facilitating transactions through it. Each travel guide is offered by its Creator, and the contract for access to a guide is between the Consumer and that Creator.

Unless explicitly stated otherwise:

  • The Company is not the author, publisher or provider of travel guides.
  • Creators are solely responsible for the content they publish, including its accuracy, quality and legality.
  • The Company does not endorse or guarantee any travel guide.
  • The Company collects payments from Consumers on behalf of Creators through its payment processor.

Where required under EU law, the Platform will clearly indicate whether a seller is acting as a trader or private individual.


3. Account Registration

  • You must provide accurate and complete information.
  • You are responsible for safeguarding your login credentials.
  • You are responsible for all activity under your account.
We reserve the right to suspend or terminate accounts for violations of these Terms.

4. Creator Terms

4.1 Ownership and License

Creators retain ownership of their travel guides. By uploading content, Creators grant the Company a non-exclusive, worldwide, royalty-free license to host, reproduce, distribute, market, and make available the content through the Platform.

4.2 Compliance with Law

Creators warrant that:

  • They own or have the rights to all uploaded materials.
  • The content complies with applicable EU and national laws.
  • The content does not infringe intellectual property rights.
  • The content is not misleading under EU consumer protection law.

4.3 Revenue Share

As long as a Creator is complying with their obligations under these Terms, the Creator will be paid an amount equal to the revenue share stated for their current plan on the Platform’s pricing page, applied to the amount paid by a Consumer to purchase access to that Creator’s guide, less applicable Taxes. “Taxes” means the taxes, duties, levies, tariffs, and other governmental charges (including, without limitation, VAT).

The Company retains the remainder as its service fee and pays payment processing fees from its own share. The Company may change plan rates with prior notice; changes do not apply to purchases already completed.

4.4 Payouts

Payouts are made through Stripe. Creators must connect and maintain an active Stripe account and keep their account and payout details current and complete. Earnings from a sale are held for 14 days after the purchase to cover refunds and chargebacks. Payouts are made every other Thursday once a Creator’s available earnings reach at least US$20 (or the equivalent in the Creator’s payout currency); smaller balances carry over to the next payout date. Bank processing times may add a few business days before funds arrive. Availability depends on the countries Stripe supports for connected accounts; if a Creator’s country is not offered during registration, the Company cannot support payouts to that Creator yet.

The Company may withhold payment, reverse transfers, or offset future payouts in cases of fraud, chargebacks, refunds, or breach of these Terms.

4.5 Taxes

Where applicable law requires the operator of an online marketplace to collect VAT or equivalent indirect taxes on sales it facilitates, the Company collects and remits those taxes. Such taxes are deducted before the Creator’s revenue share is calculated.

Creators are responsible for payment of all income and other Taxes, and any related interest and penalties, resulting from payments made to them under these Terms. Creators agree to complete any tax or other forms the Company reasonably requires in connection with those payments.


5. Consumer Purchases

5.1 Digital Content Supply

Travel guides are supplied as digital content not provided on a tangible medium. Delivery occurs immediately after successful payment unless otherwise stated.

5.2 Right of Withdrawal (EU Consumers)

If you are a consumer residing in the European Union, you normally have the right to withdraw from a digital content contract within 14 days without giving any reason.

However, by purchasing a travel guide and requesting immediate access, you:

  • Expressly consent to immediate performance of the contract; and
  • Acknowledge that you lose your right of withdrawal once download or access begins.

This waiver complies with Article 16(m) of Directive 2011/83/EU.

5.3 Conformity and Remedies

Under Directive (EU) 2019/770, digital content must:

  • Match its description;
  • Be fit for its intended purpose;
  • Be supplied in conformity with the contract.

If a guide is defective or not in conformity, consumers are entitled to:

  • Correction;
  • Replacement (where applicable);
  • Price reduction; or
  • Termination of the contract.

These rights are exercised against the Creator offering the guide, where the Creator acts as a trader. The Company facilitates remedies, including by processing refunds through its payment processor.


6. Pricing and Payment

  • All prices are displayed in USD.
  • Prices include VAT where applicable.
  • A payment processing fee is added at checkout and shown before payment is taken.
  • Payment is processed through third-party payment providers.

The Company is not liable for payment processor errors or banking delays.


7. Intellectual Property

All Platform software, branding, logos, and design elements are owned by the Company and protected by intellectual property laws.

Customers receive a limited, non-transferable license for personal use only. Resale, redistribution, or commercial reuse is prohibited.


8. Travel Disclaimer

Travel involves inherent risks. The Company does not guarantee:

  • Safety of destinations;
  • Accuracy of local regulations or visa requirements;
  • Availability of services described in guides.

Users are responsible for independently verifying travel information.


9. Limitation of Liability

Nothing in these Terms excludes liability for:

  • Death or personal injury caused by negligence;
  • Fraud or fraudulent misrepresentation;
  • Any liability that cannot be excluded under applicable EU law.

Subject to the above, the Company shall not be liable for indirect or consequential damages.


10. GDPR and Data Protection

Personal data is processed in accordance with Regulation (EU) 2016/679 (GDPR). Please refer to our Privacy Policy for detailed information about how we process personal data.


11. Dispute Resolution

If you are a consumer resident in the EU, you may bring proceedings before the courts of your country of residence.

12. Governing Law

These Terms are governed by the laws of Spain, without prejudice to mandatory consumer protection provisions applicable in your country of residence.
